Terms of Service

These Terms of Service ("Terms") govern your access to and use of NyayKavach's AI-powered litigation platform ("Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a law firm or organization, you represent that you have authority to bind that entity to these Terms.

2. Description of Service

NyayKavach provides an AI-powered NyayKavach platform that includes:

  • Court case tracking across Indian courts and tribunals
  • AI-generated hearing preparation packets
  • Citation verification and legal research assistance
  • Client communication tools
  • Compliance and deadline tracking

3. User Accounts

3.1 Registration

You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach.

3.3 Professional Verification

For advocate accounts, we may verify your Bar Council enrollment. Providing false credentials may result in account termination.

4. Acceptable Use

You agree NOT to:

  • Use the Service for any unlawful purpose
  • Share your account credentials with unauthorized users
  • Attempt to reverse engineer, decompile, or hack the Service
  • Scrape, crawl, or extract data from the Service without permission
  • Upload malicious code, viruses, or harmful content
  • Impersonate another person or entity
  • Use the Service to harass, abuse, or harm others
  • Violate any applicable laws or regulations

5. AI-Generated Content

5.1 Nature of AI Assistance

The Service uses artificial intelligence to assist with legal research and preparation. AI-generated content is provided as a starting point and requires professional review.

5.2 Professional Responsibility

You are solely responsible for verifying all AI-generated content before use. NyayKavach does not provide legal advice. All outputs must be reviewed by a qualified legal professional before reliance or submission to any court or tribunal.

5.3 Citation Verification

While we employ rigorous verification processes (RVG pipeline) to minimize citation errors, you must independently verify all citations before use in legal proceedings.

6. Intellectual Property

6.1 Our IP

The Service, including its software, design, features, and content, is owned by NyayKavach Technologies Pvt. Ltd. and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service.

6.2 Your Content

You retain ownership of all content you upload to the Service. By uploading content, you grant us a limited license to process, store, and display that content solely to provide the Service to you.

7. Fees and Payment

7.1 Subscription Plans

The Service offers various subscription plans. Fees are displayed on our pricing page and may change with 30 days' notice.

7.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as explicitly stated.

7.3 Taxes

Fees are exclusive of applicable taxes (GST). You are responsible for paying all taxes associated with your use of the Service.

8. Confidentiality

We understand the sensitive nature of legal work. We maintain strict confidentiality of your data and do not access, use, or disclose your case information except as necessary to provide the Service or as required by law.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT AI-GENERATED CONTENT IS ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE. YOU USE AI-GENERATED CONTENT AT YOUR OWN RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NYAYKAVACH TECHNOLOGIES PVT. LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless NyayKavach Technologies Pvt. Ltd., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

12.1 By You

You may terminate your account at any time through the account settings or by contacting support. Termination does not entitle you to a refund of prepaid fees.

12.2 By Us

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or if required by law. We will provide reasonable notice except in cases of serious violations.

12.3 Effect of Termination

Upon termination, your right to use the Service ceases. You may export your data within 30 days of termination. After 90 days, your data will be permanently deleted.

13. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in New Delhi, Delhi, India.

14. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
